These Terms of Service ("Terms") govern your access to and use of the website, products, and services provided by Fiftyone Group LLC, doing business as "51 Insights" ("we," "us," or "our"), including fiftyone.xyz, the 51 Terminal platform, research publications, podcast content, and consulting services (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

You acknowledge and agree that:
You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
Certain Services may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
5.1 Ownership. All content, data, information, analyses, research, scores, ratings, taxonomies, classifications, company profiles, and other materials available on or through the Services (collectively, “Platform Content”) are the exclusive property of Fiftyone Group LLC or its licensors and are protected by United States and international copyright, trademark, trade secret, and other intellectual property laws. The Platform Content constitutes a valuable trade secret and proprietary database of Fiftyone Group LLC. The compilation, organization, scoring methodology, and analytical frameworks applied to Platform Content represent original works of authorship and proprietary trade secrets.
5.2 51 Trust Score. The 51 Trust Score™ is a proprietary evaluation methodology of Fiftyone Group LLC. The scoring framework, weightings, criteria, and analytical processes underlying the 51 Trust Score constitute trade secrets. Reproduction, reverse-engineering, or derivation of the scoring methodology is strictly prohibited.
5.3 License Grant. Subject to these Terms, Fiftyone Group LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services solely for your internal business purposes.
5.4 Restrictions. This license does not include the right to: (a) copy, reproduce, distribute, republish, download, display, post, or transmit any Platform Content in any form or by any means; (b) modify, create derivative works from, reverse engineer, disassemble, decompile, or otherwise attempt to derive the source code, algorithms, scoring methodologies, or data structures of the Services; (c) use any automated means, including robots, crawlers, scrapers, data mining tools, or similar technologies to access, acquire, copy, or monitor any portion of the Services or Platform Content; (d) systematically download, store, or cache Platform Content for use outside the Services; (e) redistribute, resell, sublicense, or make available any Platform Content to any third party; (f) use Platform Content to create, train, or improve any competing product, service, database, or intelligence platform; (g) use Platform Content to train, fine-tune, validate, or evaluate any machine learning model, AI system, or automated decision-making system; (h) remove, obscure, or alter any proprietary notices, labels, or marks on the Services or Platform Content; (i) use Platform Content in any deliverable, report, presentation, or work product for a third-party client without the prior written consent of Fiftyone Group LLC.
5.5 Limited Fair Use. Notwithstanding the foregoing restrictions, authorized subscribers may: (a) view and temporarily display Platform Content on personal devices for internal business evaluation; (b) include limited excerpts of Platform Content (not to exceed five data points per company record) in internal memoranda, provided that such use includes prominent attribution to “51 Insights / 51 Terminal” and does not substitute for a subscription to the Services.
6.1 General Conduct. When using our Services, you agree not to: (a) violate any applicable law or regulation; (b) infringe on the rights of others; (c) attempt to gain unauthorized access to our systems or other users’ accounts; (d) share your account access or login credentials with any unauthorized party; (e) interfere with or disrupt the operation of our Services.
6.2 Prohibited Data Practices. You shall not: (a) use any automated means, including robots, crawlers, scrapers, spiders, or similar tools, to access, monitor, or copy any portion of the Services; (b) systematically extract, download, or store Platform Content in any database, spreadsheet, or external data repository; (c) use the Services to develop, enhance, or populate any competing product, service, or database; (d) access the Services at a volume or frequency that indicates automated or systematic extraction rather than normal human use; (e) attempt to derive, replicate, or reconstruct the 51 Trust Score methodology, taxonomy logic, or any proprietary scoring algorithm; (f) bypass or attempt to bypass any technical measures implemented to restrict access or protect Platform Content.
6.3 Anti-Competitive Use. You shall not use the Services or Platform Content, directly or indirectly, to: (a) build, populate, or enhance any database, product, or service that competes with or substitutes for the Services; (b) provide Platform Content or derivative insights to any third party for the purpose of enabling such third party to avoid purchasing a subscription; (c) benchmark the Services or Platform Content against competing products for competitive intelligence purposes, unless expressly authorized in writing.
6.4 Acceptable Use Policy. Your use of the Services is also subject to the Acceptable Use Policy available at fiftyone.xyz/acceptable-use, which is incorporated into these Terms by reference.
Any unauthorized use of the Services or Platform Content constitutes a material breach of these Terms and may violate copyright, trademark, trade secret, and other laws. Fiftyone Group LLC reserves the right to: (a) immediately terminate your access without notice or refund; (b) pursue injunctive relief without the necessity of proving actual damages or posting a bond; (c) recover actual damages, statutory damages, and reasonable attorneys’ fees; (d) report violations to appropriate law enforcement authorities. You acknowledge that unauthorized use of Platform Content may cause irreparable harm to Fiftyone Group LLC for which monetary damages would be inadequate, and that Fiftyone Group LLC shall be entitled to seek equitable relief, including injunction and specific performance, in addition to all other remedies available at law or in equity.
Our Services may contain links to third-party websites, tools, or services. We do not control and are not responsible for the content, privacy practices, or availability of third-party services. Your use of third-party services is at your own risk and subject to their respective terms.
Our Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

To the fullest extent permitted by applicable law, Fiftyone Group LLC and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of our Services, whether based on warranty, contract, tort, or any other legal theory.
In no event shall our total liability to you for all claims arising out of or relating to these Terms or your use of our Services exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless Fiftyone Group LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of our Services, your violation of these Terms, or your violation of any rights of another party.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Rules, conducted in Miami-Dade County, Florida. Notwithstanding the foregoing, Fiftyone Group LLC may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights and trade secrets.
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Your continued use of our Services after changes are posted constitutes acceptance of the updated Terms. If you do not agree with the revised Terms, you must stop using our Services.
We may suspend or terminate your access to our Services at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination, your right to use our Services will immediately cease.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
